In California, the law requires that engineers and other high-tech employees be paid overtime that is commensurate with their job duties and their hours worked. Although many companies attempt to avoid this requirement by classifying engineers as exempt employees, these companies do not realize — or do not care — that the law is only concerned with day-to-day job duties. It does not defer to the job titles employees are given or the salary classification the employer imposes; this allows those who conduct primarily repetitive, routine, nondiscretionary and/or mechanical tasks to receive overtime pay when employers require them to work long hours and misclassify them as exempt.
